How we compile the figures that show our success rate with trademark application.
We maintain a record of all trademarks we file on a trademark management database and we use this to collate our figures.
The success rate is determined by the number of trademarks we file that proceed to registration anywhere in the world. We use data for a twelve-month period from the 1st August to 31st July.
The following trademarks are excluded from these figures:
- Trademarks that have had an opposition filed against them, but the proceedings are not as yet complete. These trademarks will be included in our figures in the year that the outcome of the application is known.
- Trademarks where we have advised a client that an absolute grounds objection will be received. In other words, the Registry rejects the application when it is filed and we were not authorised to file arguments. There were 2 trademarks that fulfil this criteria in the relevant period.
- Where there has been a third-party objection, but the client has elected not to defend the application at all and we have not had the opportunity to overcome it. There was 1 trademark that fulfils this criteria in the relevant period.
